![Axcet HR consultant offering guidance on personnel file request laws, deadlines and employee access rights.](https://blog.axcethr.com/hs-fs/hubfs/personnel-file-request%20(1).webp?width=1200&height=800&name=personnel-file-request%20(1).webp)

If one of your employees makes a personnel file request to HR, what do you, as the employer, need to provide and how fast? State law plays a big role in that answer for private employers, because there’s no federal rule that gives private sector employees specific access rights.

State requirements can be very different when it comes to what records you have to provide, how quickly, who gets access, whether employees can see or receive copies, and what information you can withhold.

## Why Would an Employee Request Their Personnel File?

There can be several reasons why an employee might request their file. A lot of employers get nervous and assume it’s because litigation is coming, but that’s not always the case. Some other reasons are to:

- Check to see if the records are accurate

- Get a better understanding of an employment decision

- Go over [disciplinary records](https://blog.axcethr.com/progressive-discipline-in-the-workplace) or evaluations

- Get documentation after a termination or resignation

- Verify their compensation, employment, or job history information

- Collect information about a dispute

As an employer, it’s important not to automatically assume that a request is the start of a legal claim, but you also shouldn’t dismiss the possibility. When you treat every employment records request consistently and follow the law, you reduce risk to you and your organization. Also, be sure to maintain a clear record of how you handled the request, in case there are questions later.

## Do Employees Have a Right to Make a Personnel File Request?

There’s no uniform rule for private sector employers and whether they have to allow employees access to their personnel files. Instead, each state creates its own laws around the rights and obligations for cases where an employee asks to see their personnel file.

Depending on which state your company is in, the laws in your area may address whether current employees can request their records, and whether former employees have different rights. Laws can also include how the request can be made (in writing, etc.), how fast you have to answer, and whether the employee can see the file, get copies, or both.

Not only that, but some states have laws about how often an employee can make a request, which records you can (or must) exclude, and whether you can charge a fee if you provide the employee with copies.

As an example, Illinois law states that qualifying current employees and some former employees who left the company in the previous year can inspect or get copies of their files. In Washington, you have 21 calendar days to get requested records to an employee, and those who have left the company in the past three years are usually included.

Personnel file laws by state can be very different, so you’ll want to identify the law that applies where the employee works before you respond to a request.

## What Should Employers Do When They Receive a Personnel File Request?

Having a consistent process makes it easier for you to respond to employee records requests without overlooking information disclosure requirements. Some things need to remain confidential.

### Determine Which State Law Applies

Step one is to see where the employee works or worked, then determine whether they’re still working for your company and when their employment ended if they’ve left.

These are the biggest details that affect whether the employee can access the records they’re asking about and how you have to handle that request. At that time, you should also check whether there are any internal policies, collective bargaining, or employment agreements that create more obligations.

It’s crucial not to assume that the laws that affect one employee’s request are the same as the laws affecting another employee in a different state.

### Confirm What the Employee Is Requesting

Take time to carefully read the request. Your employee might be asking to see their personnel file, or may want a copy of it. They could also be looking for just one specific record, or be asking for everything you have regarding them. Those requests aren’t always treated the same under current laws.

For example, requesting a performance review record may be narrower than requesting the entire file. There may also be a legal right to inspect certain records that doesn’t include some other records you can hold back. Ensuring you understand the scope of the request can help your HR department know which records are affected and what your obligations are.

### Review the Records Before Providing Them

It’s generally never a good idea to just export an HR folder and send it to the employee without looking at it first. Personnel files can have information you need to exclude or redact, or that should be handled separately. Depending on specific state laws, you might need to look through the records for:

- Information about other employees

- Anything that’s attorney-client privileged communication

- Materials that are part of an investigation

- [Confidential medical data](https://blog.axcethr.com/employment-related-medical-exams-and-inquiries-present-compliance-quagmire-for-employers)

- Records that are specifically excluded per state law

- Any other confidential details

As an example of this, California is one of the states that exclude some categories of personnel records from inspection and lets you redact the names of nonsupervisory employees in some circumstances.

You should base your file review process on the applicable state law in every instance, instead of assuming that everything in the folder can be transmitted to the employee making the request.

### Meet the Applicable Deadline and Document the Response

Once you get the request, record the date and figure out the response deadline. Some states have specific deadlines, while others have certain copying and inspection procedures. You’ll want HR to track the request all the way through its completion, while documenting when it was received, what law governed the response, what records were reviewed, and which ones were provided, inspected, or withheld.

Also make note of any specific redactions or exclusions, as well as when and how you delivered the response to the employee. When you have all this documentation, you can show that you handled the request properly, consistently, and with applicable laws in mind.

## Can a Former Employee Request Their Personnel File?

Former employees can often request their personnel files, but it depends on state law. [Termination or resignation](https://blog.axcethr.com/know-before-they-go-how-to-ease-the-pain-of-employee-departures) doesn’t necessarily end a person’s right to their personnel records. Some states give former employees access rights, but others set time limits or other eligibility requirements.

California has access rights subject to statutory procedures, Illinois covers certain employees who left within the past year, and Washington generally allows access for former employees who left within the last three years.

Because many states have laws that allow former employees access to their personnel files, you shouldn’t automatically say no to a request from someone who used to work for you. Instead, take a look at whether the law covers them and whether there are deadlines or eligibility requirements that apply.

So, can an employee request their personnel file after termination? Often yes, but with important caveats.

## What If an Employee Requests Their Personnel File Before Termination?

If HR is getting ready to terminate an employee and that employee requests their personnel file, the request can become very sensitive. In that scenario, you’ll want to treat the personnel file request and termination decision as separate processes. Getting the request doesn’t mean you need to stop what you’re doing, but it does mean you need to be very careful with documentation.

First, preserve the existing file without removing, altering, backdating, or creating additional documentation just because the employee asked for their records.

Along with doing that, you and your managers, as well as HR, should continue any legitimate, normal documentation of the ongoing termination process. While that’s going on, look into the applicable laws so you’ll know whether those documents become part of what you must show the employee.

If the personnel file request happens at the same time as a complaint accommodation, request for protected leave, whistleblower activity, or anything that could create legal risk, you’ll need to use extra caution. In those circumstances, you may want to involve experienced HR professionals or employment counsel to protect your interests.

## Can an Employee Request a Copy of Their Personnel File?

Getting a copy of their file isn’t the same thing as being allowed to view it. Some states require you to provide copies, and others have inspection rights, along with separate rules about copying.

Washington, for example, requires you to provide a copy of the file for free. California has inspection and copy rights based on state statutes. Don’t assume that an employee’s right to inspect their file means you have to provide them with a copy of every record you have for them.

## Create a Process for Employee Records Requests

Creating a straightforward process for personnel file requests makes them a lot easier to manage and helps reduce your legal risk. A simple process might look like:

1\. Receive the request

2\. Identify the applicable state law

3\. Determine current or former employee status

4\. Clarify the scope of the request

5\. Review the records

6\. Redact or exclude protected information, where applicable

7\. Meet the law’s deadline

8\. Document the response

A consistent personnel file request process helps you and your HR team recognize when a routine employee records request might need some additional review.

Because state requirements and laws can change, make sure you take extra care with requests that involve more than one state, former employees, and any potential employment claims.

"alternativeHeadline" : "If one of your employees makes a personnel file request to false",
"articleBody" : "If one of your employees makes a personnel file request to HR, what do you, as the employer, need to provide and how fast? State law plays a big role in that answer for private employers, because there’s no federal rule that gives private sector employees specific access rights. State requirements can be very different when it comes to what records you have to provide, how quickly, who gets access, whether employees can see or receive copies, and what information you can withhold. Why Would an Employee Request Their Personnel File? There can be several reasons why an employee might request their file. A lot of employers get nervous and assume it’s because litigation is coming, but that’s not always the case. Some other reasons are to: Check to see if the records are accurate Get a better understanding of an employment decision Go over disciplinary records or evaluations Get documentation after a termination or resignation Verify their compensation, employment, or job history information Collect information about a dispute As an employer, it’s important not to automatically assume that a request is the start of a legal claim, but you also shouldn’t dismiss the possibility. When you treat every employment records request consistently and follow the law, you reduce risk to you and your organization. Also, be sure to maintain a clear record of how you handled the request, in case there are questions later. RELATED: Employee File - What to Include and How Long to Keep Records >> Do Employees Have a Right to Make a Personnel File Request? What Should Employers Do When They Receive a Personnel File Request? Having a consistent process makes it easier for you to respond to employee records requests without overlooking information disclosure requirements. Some things need to remain confidential. Determine Which State Law Applies Step one is to see where the employee works or worked, then determine whether they’re still working for your company and when their employment ended if they’ve left. Confirm What the Employee Is Requesting Take time to carefully read the request. Review the Records Before Providing Them It’s generally never a good idea to just export an HR folder and send it to the employee without looking at it first. Personnel files can have information you need to exclude or redact, or that should be handled separately. Depending on specific state laws, you might need to look through the records for: Information about other employees Anything that’s attorney-client privileged communication Materials that are part of an investigation Confidential medical data Records that are specifically excluded per state law Any other confidential details As an example of this, California is one of the states that exclude some categories of personnel records from inspection and lets you redact the names of nonsupervisory employees in some circumstances. You should base your file review process on the applicable state law in every instance, instead of assuming that everything in the folder can be transmitted to the employee making the request. Meet the Applicable Deadline and Document the Response Once you get the request, record the date and figure out the response deadline. RELATED: Wrongful Termination - What Employers Need to Know >> Can a Former Employee Request Their Personnel File? Former employees can often request their personnel files, but it depends on state law. Termination or resignation doesn’t necessarily end a person’s right to their personnel records. What If an Employee Requests Their Personnel File Before Termination? Can an Employee Request a Copy of Their Personnel File? Getting a copy of their file isn’t the same thing as being allowed to view it. Some states require you to provide copies, and others have inspection rights, along with separate rules about copying. Washington, for example, requires you to provide a copy of the file for free. California has inspection and copy rights based on state statutes. Don’t assume that an employee’s right to inspect their file means you have to provide them with a copy of every record you have for them. Create a Process for Employee Records Requests Creating a straightforward process for personnel file requests makes them a lot easier to manage and helps reduce your legal risk. A simple process might look like: 1. Receive the request 2. Identify the applicable state law 3. Determine current or former employee status 4. Clarify the scope of the request 5. Review the records 6. Redact or exclude protected information, where applicable 7. Meet the law’s deadline 8. Document the response A consistent personnel file request process helps you and your HR team recognize when a routine employee records request might need some additional review. Because state requirements and laws can change, make sure you take extra care with requests that involve more than one state, former employees, and any potential employment claims.
